Terms and Conditions of Sale

1. Identity and scope
These Terms and Conditions of Sale, referred to below as the “Terms”, govern sales made by Ethnic World SA, Route des Saviez 10, 1845 Noville, Switzerland, through the Ethnic.ch website.
They apply to orders for products or services placed through the website, subject to any mandatory provisions to the contrary. Mandatory provisions protecting consumers remain reserved at all times.
2. Customer and capacity
The customer may be an individual or a legal entity. By placing an order, the customer confirms having the capacity required to enter into the contract and, where required by the nature of the product, being at least 18 years old.
The customer is responsible for the accuracy of the information supplied when creating an account and placing an order.
3. Products and information
Ethnic World SA endeavours to present products and their characteristics accurately. Illustrations, photographs, technical information and manufacturer information are nevertheless provided for information purposes unless a characteristic is expressly guaranteed in the order confirmation.
The customer remains responsible for checking that the selected product is suitable for the intended use and complies with any requirements applicable to its use.
4. Orders and conclusion of the contract
Before confirming an order, the customer can review the basket, contact details, delivery method, available payment methods and total price and correct any errors.
Submitting an order constitutes an offer to purchase addressed to Ethnic World SA. The contract is concluded when Ethnic World SA accepts the order, in particular by sending an order confirmation or by performing the order.
Ethnic World SA may refuse or cancel an order where there is a legitimate reason, including unavailability, an obvious error, suspected fraud or inability to perform the order.
5. Prices and taxes
The prices applicable are those displayed when the order is placed. Taxes, delivery charges and other applicable costs are shown before the order is finally confirmed.
Unless otherwise stated, payments are made in Swiss francs (CHF).
6. Payment
The available payment methods are those offered to the customer during checkout. Their availability may depend on the type or amount of the order, the customer profile or other technical or commercial criteria.
Where electronic payment is selected, processing may be carried out by a specialised payment service provider. The order may remain pending until payment has actually been confirmed.
7. Availability
Offers are subject to stock availability. A stock indication is not an absolute guarantee until the order has been accepted.
If a product becomes unavailable after an order is placed, Ethnic World SA will inform the customer and may, depending on the circumstances, offer a new delivery date, replacement product, partial delivery, credit or refund.
8. Delivery
The online shop currently delivers within Switzerland. Available delivery methods, prices and indicative delivery times are shown during checkout.
Depending on the order and delivery address, shipping may in particular be carried out by Swiss Post or Planzer. Delivery times are estimates unless expressly agreed otherwise.
9. Collection in Noville
Where offered during checkout, customers may collect their order from Ethnic World SA in Noville. Customers must wait for confirmation that the order is ready before travelling to collect it.
10. Checking delivery and errors
Customers are asked to inspect goods upon receipt and promptly report delivery errors, visible damage or discrepancies with the order.
An error attributable to Ethnic World SA will be corrected at the expense of Ethnic World SA. Mandatory customer rights relating to defective products remain reserved.
11. Cancellation and voluntary commercial returns
Swiss law does not provide a general right to cancel purchases concluded online. Unless mandatory law or an express commitment by Ethnic World SA provides otherwise, customers therefore have no automatic right to return goods merely because they have changed their mind.
Ethnic World SA may nevertheless, as a voluntary commercial gesture, accept a written return request made within five days after delivery. Such acceptance is voluntary and does not constitute a general cancellation right.
12. Return procedure
All returns require the prior agreement of Ethnic World SA. Customers must follow the return instructions provided by customer service.
For a voluntary commercial return, the product must in principle be complete, properly packaged, unused and accompanied by its original accessories and packaging.
13. Warranty for defects
Customers should report defects within a reasonable period after discovery.
Warranty rights depend in particular on the customer's status, the nature of the product, the contractual provisions and applicable mandatory law. For consumer sales, the mandatory minimum periods provided by Swiss law remain reserved.
Where a defect is accepted, Ethnic World SA may, to the extent permitted by law and depending on the circumstances, provide a repair, replacement, price reduction or refund.
Any manufacturer's warranty may supplement existing rights but does not reduce mandatory rights available against the seller.
14. Products excluded from voluntary commercial returns
For technical, hygiene or safety reasons or due to their nature, certain opened, unsealed, used or consumable products may be excluded from voluntary commercial returns, including fertilisers, certain probes and measuring instruments, lamps and activated carbon filters.
This exclusion does not apply where mandatory rights arise because a product is defective.
15. Liability
Ethnic World SA is liable for loss or damage in accordance with mandatory Swiss law.
To the extent permitted by law, Ethnic World SA is not liable for loss caused by use contrary to instructions, improper installation, unauthorised modifications, unsuitable use or events reasonably outside its control.
Any limitation of liability in these Terms is ineffective to the extent that it would conflict with mandatory law, in particular in cases of intent or gross negligence.
16. Installation and use of products
Customers must comply with manufacturer instructions and the legal and safety requirements applicable to the product concerned.
Equipment requiring a qualified professional for legal or technical reasons must be installed and connected by an appropriately competent person.
17. Retention of title
To the extent permitted under Swiss law, Ethnic World SA retains ownership of the goods until the corresponding price has been paid in full.
18. Customer obligations
Customers must cooperate in good faith in the performance of the order, provide accurate information and take the measures reasonably required for delivery, payment and, where applicable, after-sales service.
19. Intellectual property
Trademarks, texts, photographs, logos, technical documents and other website content remain the property of their respective rights holders. Their presence on Ethnic.ch does not transfer any intellectual property rights.
20. Data protection
Ethnic World SA processes personal data in accordance with applicable Swiss data protection law.
Detailed information concerning the data processed, purposes, service providers, disclosures abroad, retention periods and data-subject rights is contained in the Privacy Policy published on Ethnic.ch. Cookies and similar technologies are described in the Cookie Policy.
21. Changes to the Terms
The version applying to an order is the version made available to the customer at the time of that order.
Ethnic World SA may amend these Terms for future orders. A later amendment does not retroactively change a contract already concluded unless the parties agree otherwise or the law provides otherwise.
22. Governing law, jurisdiction, languages and severability
The contractual relationship with Ethnic World SA is governed by Swiss law.
Subject to mandatory statutory jurisdictions, the place of jurisdiction is the registered office of Ethnic World SA in Noville (VD). Mandatory jurisdictions applicable in particular to consumers are expressly reserved.
These Terms are available in French, Italian, German and English. In the event of differences between translations, the French version serves as the reference version, subject to applicable mandatory rights.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain effective to the extent permitted by law.
